2. General Provisions and Acceptance

2.1. This Consent governs the use of artificial intelligence functions ("AI functions", "AI offices") on the ATS Office platform (atsoffice.ru, app.atsoffice.ru; the "Platform", the "Service"). The Platform is an information and technology service that provides business users with access to AI offices and tools for automation, preparation of materials, data processing, and analytics.

2.2. By starting to use the AI functions of the Platform, the User confirms that they have read and accepted all terms of this Consent. If the User does not agree with any of the terms, the User must refrain from using the AI functions.

2.3. "User" or "Customer" means a person who uses the AI functions on their own behalf or on behalf of a business they represent, including a legal entity or an individual entrepreneur. If this Consent is accepted by a representative of an organisation, that representative confirms that they have the necessary authority.

2.4. This Consent forms an integral part of the terms of use of the Platform and applies together with the Public Offer, the Privacy Policy, the Personal Data Processing Consent, and the Data Processing Instruction.

3. Scope of AI Functions and AI Offices

3.1. An AI office is a functional module of the Platform designed to perform a specific class of tasks. The available AI offices and functions depend on the selected tariff, the User's settings, and the technical availability of modules. The Platform may include, among other things:

  • Content Machine — topic selection, trend and competitor analysis, preparation of scripts, short videos, covers, brand inserts, and publications for different platforms; at the User's decision, publication to connected social networks and channels; the ability to connect the User's own services, including avatar, video, and voice-over services through third-party providers.
  • Mentor — an embedded AI assistant that answers based on materials and knowledge bases uploaded by the User, within the selected tone and topic boundaries; it may be connected to a website, personal account, educational programme, bot, or internal system of the User; it may support voice mode depending on the tariff.
  • Customer Attraction / Outreach — selection of external platforms, including chats, channels, communities, administrators, and ambassadors; assessment of platforms; preparation of outreach messages and support of placement negotiations within the rules set by the User; transfer of contacts to the Partner Sales office.
  • Business Analytics — analysis of the website, demand, competitors, channels, return on investment, search visibility (SEO), visibility in generative AI engines (GEO), and weak points in the funnel; at the User's choice, connection of the User's analytics accounts and data.
  • Partner Sales — a partner and referral programme: promo codes, links, personal accounts, partner levels, accruals, payout requests, and review of disputed sales. This office is primarily an accounting and operations module, not a generative AI office.

3.2. The list of functions is provided for information only and does not guarantee the availability of a specific function under a specific tariff. The availability of individual functions may change.

4. Nature and Limitations of AI Functions

4.1. Informational and assistive nature. AI offices generate preliminary content, analytical outputs, assistant responses, selections of channels, contacts, or platforms, and other outputs to support the User's business. All outputs are advisory in nature and are intended for further review and refinement by the User.

4.2. Not professional advice. AI outputs do not constitute legal, accounting, tax, financial, marketing, medical, HR, or any other professional advice that requires special authorisation, licensing, or professional status. They do not replace consultation with qualified specialists. Decisions in the relevant fields must be made by the User with the involvement of appropriate professionals.

4.3. Possible inaccuracies. AI functions are based on probabilistic algorithms. Despite the uploaded materials and settings, they may produce inaccurate, incomplete, outdated, or fabricated information ("hallucinations"). The Operator does not guarantee the accuracy, completeness, or suitability of AI outputs for the User's specific tasks.

5. Terms of Use

5.1. Legal capacity and authority. The User confirms that they are of legal age and legally capable, act voluntarily, and have the necessary authority to act on their own behalf or on behalf of the business they represent.

5.2. Voluntary use. The use of AI functions is voluntary. The User may stop using them at any time.

5.3. Responsibility for decisions and mandatory review. All business decisions and actions taken by the User based on AI outputs are made at the User's own discretion and responsibility. The User must critically assess and independently verify AI outputs, including facts, figures, legal and advertising wording, before publishing, sending, transferring to third parties, or applying them in commercial, managerial, legal, financial, HR, advertising, educational, or other significant activity.

5.4. Lawful use. The User must use AI functions only for lawful purposes. The User may not input third-party data without a legal basis, create prohibited, spam, fraudulent, or misleading content, bypass restrictions of external platforms, distribute unlawful advertising, or perform any other unlawful actions. In case of violation, the Operator may restrict or terminate access to AI functions.

6. Advertising and Labelling

6.1. If the User uses AI functions to prepare, place, or distribute advertising, the User acts as the advertiser and independently fulfils the obligations provided by the legislation of the Russian Federation on advertising, including advertising labelling, obtaining and indicating the advertising identifier (erid), submitting information to an advertising data operator (ORD) and to the Unified Register of Internet Advertising (ERIR), and complying with advertising content requirements. These obligations are governed by the Public Offer and are not changed by this Consent.

6.2. The decision to place advertising, its parameters, and the content of communications to external platforms is made by the User. AI functions only select possible platforms and prepare preliminary messages and materials.

6.3. A separate service for submitting information to an ORD on behalf of and upon the instruction of the User, if connected, does not release the User from responsibility for the accuracy of the information and the legality of advertising.

7. Autonomous Actions and Human Involvement

7.1. Human in the loop. Certain AI offices, including Customer Attraction / Outreach, may prepare and perform semi-automated actions within the rules and limits set by the User, such as selecting platforms, preparing and sending communications, and supporting negotiations. Disputed and significant decisions are passed to the User for confirmation. The final decision on sending a communication, its content, and any placement is made by the User.

7.2. No legally significant decisions without a human. Automated processing on the Platform is not intended to make legally significant decisions concerning the User or third parties without human involvement.

8. Data and Confidentiality

8.1. Processing and retention periods. Data entered by the User into AI functions, including text requests, user materials, module settings, activity history, processing results, technical data, and account identifiers, is processed to generate results, operate the Platform, ensure security, and perform the contract. The processing period is determined by the achievement of processing purposes, the term of the contract, statutory retention periods, and the validity period of the consent, in accordance with the Privacy Policy.

8.2. Transfer to providers and other subcontractors. To generate a result, certain data may be transferred to providers of artificial intelligence technologies, providers of automated data processing, hosting providers, communication services, analytics services, and maintenance and security contractors, to the extent necessary for the relevant function to operate and subject to confidentiality and legal requirements. The categories of third parties involved are disclosed in the Privacy Policy.

8.3. Russian personal data processing contour. Personal data processed by AI functions is processed within the Russian contour. Personal data is not transferred to foreign AI models. If such models are used, only anonymised requests that do not contain personal data may be sent to them. The User may restrict the scope of data transferred to AI functions.

8.4. Model training. The Operator does not use the content of the User's data to train its own models. Providers of artificial intelligence technologies involved in the operation of the Platform process the transferred data only to the extent necessary to generate the result and in accordance with applicable terms and law.

8.5. Cross-border transfer. If cross-border transfer of personal data is required for certain functions or providers, it is carried out in accordance with the Privacy Policy and the requirements of Russian law.

8.6. Third-party data and processing on instruction. If the User uploads personal data of third parties to the Platform, the Operator processes such data on the User's instruction in accordance with the Data Processing Instruction and the Privacy Policy. The User guarantees that they have the necessary legal basis and consents of the personal data subjects.

8.7. Data minimisation. The User should not enter excessive personal data of third parties, special categories of data, secrets such as passwords, tokens, access keys, or information that must not be disclosed into AI functions. The Platform allows the User to restrict what data is transferred to AI models. Some data may be excluded from transfer. Data transmission over the internet involves general risks accepted by the User.

8.8. Voice data. Certain functions, such as the voice mode of the Mentor assistant, may process audio data. Availability depends on the tariff and the User's settings. Processing is carried out within the Russian contour. The procedure for processing voice data is determined by the Privacy Policy.

9. Limitation of Liability and Warranties

9.1. As is. AI functions are provided "as is". The Operator does not guarantee uninterrupted or error-free operation, compliance with the User's expectations, or suitability of outputs for a specific situation.

9.2. Inaccuracies are not in themselves a defect of the service. Possible inaccuracies, ambiguous wording, absence of the expected effect, or the User's subjective assessment of the usefulness of AI outputs do not in themselves constitute a defect of the service, provided that the services correspond to their description.

9.3. No guarantee of results. The Operator does not promise or guarantee that the User will achieve any specific business results from using AI functions, including growth in sales, receiving leads, increasing revenue or profit, improving search rankings, increasing reach, attracting partners, or successfully placing materials.

9.4. No liability for consequences of use. The Operator is not liable for direct or indirect consequences of the User's use of AI outputs, including decisions made, published content, lost profits, or other losses. The User is responsible for reviewing and applying the outputs.

9.5. Technical failures and third parties. The Operator is not liable for failures caused by technical reasons, server infrastructure issues, actions of service providers, payment systems, or other third parties, but will make reasonable efforts to restore operation.

9.6. Not a substitute for professional assistance. AI functions provide informational and assistive support and do not replace professional legal, accounting, tax, financial, medical, psychological, or other specialised assistance.

10. Acceptance and Changes

10.1. Acceptance. Acceptance of this Consent is confirmed by the User's conclusive actions, including starting to use AI functions, ticking a consent checkbox, or taking other actions that clearly indicate consent, in a manner similar to the acceptance of the Public Offer and the Personal Data Processing Consent.

10.2. Changes. The Operator may amend this Consent by publishing a new version on atsoffice.ru. Continued use of AI functions after the update means that the User agrees to the new version.

11. Final Provisions

11.1. Connection with the Public Offer. This Consent is an appendix to the Public Offer and forms an integral part of it. Matters not regulated by this Consent are governed by the Public Offer and the Privacy Policy.

11.2. Applicable law. The use of AI functions is governed by the laws of the Russian Federation. Disputes are resolved in accordance with Russian law.

11.3. Contact. For questions related to AI functions or this Consent, the User may contact: support@atsoffice.ru.
